suit filed by Kawu Baraje’s faction of the Peoples’
Democratic Party (PDP) demanding to stop PDP's Chairman, Bamanga Tukur,
and other members of his Executive Council from parading themselves as
national officers of the party, has suffered a setback at the Lagos High
Court,Ikeja.
The setback happened due to Justice Ganiyu Safari, who has been handling the matter as vacation judge while the Lagos Judiciary was on a vacation for two months, has signaled his withdrawal from the case.
All the parties were present in court today. But the suit failed to proceed as scheduled because the case file had been returned to the office of the Chief Judge by Justice Safari.
The suit has been re-assigned to a new judge, Justice Oludotun Adefowope-Okojie.
At the last hearing of the suit, the judge had set Tuesday for the hearing of the defendant’s application in which they questioned the jurisdiction of the court to entertain the suit.
Alhaji Baraje and four others had dragged the Alhaji Bamanga Tukur led PDP before the court asking it to restrain the embattled chairman and his co-defendants from parading themselves as PDP NEC members. Other claimants are Dr Sam Jaja and Prince Olagunsoye Oyinlola.
Justice Adefowope-Okojie fixed September 30 to commence hearing of the suit.
Earlier this month, an Ikeja High Court, Lagos, declined an application to order the re-opening of the secretariat of the PDP splinter faction(PDP) closed by the policeIn. In his ruling, Justice Safari, stated there was no proof that Tukur or other defendants ordered the police to close the claimants’ office, and therefore dismissed the application. On September 13, however, Abuja High Court ruled that 'new PDP' should be allowed to operate without any harassment or inhibition as its existence does not contravene any known law.
